Nowe przepisy dotyczące samodzielnych funkcji technicznych w budownictwie

W artykule omówiono aktualne przepisy prawa budowlanego dotyczące samodzielnych funkcji technicznych w budownictwie po zmianach wywołanych przepisami ustawy z dnia 9.05.2014 r. o ułatwianiu dostępu do wykonywania niektórych zawodów regulowanych. Wprowadziły one istotne zmiany w rozdziale 2 ustawy – Prawo budowlane i spowodowały wydanie nowego rozporządzenia Ministra Infrastruktury i Rozwoju z dnia 11.09.2014 r. w sprawie samodzielnych funkcji technicznych w budownictwie, które uregulowało rodzaje i zakres przygotowania zawodowego do wykonywania samodzielnych funkcji technicznych w budownictwie, sposób stwierdzania posiadania przygotowania zawodowego i jego weryfikacji, oraz wprowadziło ograniczenia zakresu uprawnień budowlanych.

The article discusses the current building regulations on independent technical functions in the construction industry after the changes caused by the act dated 09.05.2014 r. by facilitating access to certain regulated professions. They introduced significant changes in Chapter 2 of the Act – Construction Law and led to the release of the new Regulation of the Minister of Infrastructure and Development of 09.11.2014 on independent technical functions in the construction industry, which regulates the types and scope of vocational training to perform technical functions in the construction industry, way to declare ownership of professional preparation and verification on the scope of building permissions.
