Compensation for additional work related to the performance of a public contract settled on a flat-rate basis

One of the reasons for the contractors of public contracts for construction works to earn a lower margin than assumed at the stage of calculation of the offer price (in particular the lump sum) is the performance of additional works based on oral arrangements with persons (e.g. investor supervision inspector) who do not have the legal obligation to incur financial liabilities on behalf of and for the contracting authority, and lack of effectiveness in claiming additional remuneration on this account. The article presents and analyzes the instruments giving contractors a legal basis to make cost claims in the event of the need to perform additional works related to the implementation of the contract concluded within the provisions of the Act of 11/09/2019 - Public Procurement Law, settled on a flat-rate basis.
