Procedura wywłaszczenia nieruchomości

The subject of study is expropriation procedure. The paper takes the issues related to an explanation of the concept of expropriation and property and treats of the nature and importance of the public in this procedure. It also includes a discussion of issues related to the sides involved in the procedure of expropriation and take the issues related to associated with the object and scope of the expropriation, and in the present study were taken issues of carrying out the same procedure is taking the negotiations, the decision or its consequences. Study also includes the issue of compensation for expropriation the nature of law and the principles of compensation resulting from the Law on Real Estate.

Przedmiotem pracy jest procedura wywłaszczenia nieruchomości. Praca podejmuje problematykę związaną z wyjaśnieniem pojęcia wywłaszczenia i własności oraz traktuje o istocie i znaczeniu celu publicznego w tej procedurze. Zawiera również omówienie kwestii związanych ze stronami biorącymi udział w procedurze wywłaszczenia oraz podejmuje problematykę związaną z przedmiotem i zakresem wywłaszczenia, a także zostały w niniejszej pracy podjęte zagadnienia związane z przeprowadzeniem samej procedury, tj., z podjęciem rokowań, wydaniem decyzji, czy też jej skutkami. Praca obejmuje również problematykę odszkodowania za wywłaszczenie, jego charakteru prawnego oraz zasad odszkodowania wynikających z ustawy o gospodarce nieruchomościami.
