Literary translation and the copyright

Praca pt. "Tłumaczenie literackie - zagadnienia autorskoprawne" podejmuje zagadnienie tłumaczenia literackiego w świetle nauk prawnych (prawo autorskie), ale z uwzględnieniem szerszego tła: współczesnych teorii literaturoznawczych i translatologicznych. Porównanie pojęć funkcjonujących w ramach siatek pojęciowych wymienionych dziedzin (takich jak: utwór, autor, tłumaczenie, osoba tłumacza) pozwala podkreślić ich differentia specifica i uwzględnić nowe konteksty rozumienia. W pracy weryfikowana zostaje przydatność koncepcji warstwowej budowy utworów A. Kopffa dla prawnej oceny utworów zależnych. Rozwinięte zostaje zagadnienie współautorstwa tłumaczenia literackiego oraz problemu plagiatu w tłumaczeniu. W pracy zwraca się uwagę na szczególny przypadek jakim jest autotłumaczenie i wiążące się z nim problemy prawne.

The thesis 'Copyright aspects of literary translation' is an attempt to create a bridge between legal sciences of the copyright and the current literary and translation theories. The comparison of the notions of aforementioned sciences (including terms such as: the author and the work, the translator and the translation etc.) will facilitate the ways to determine and to emphasize the differentia specifica of the analyzed sciences in order to examine the compatibility of the meaning carried by the respectful sciences behind those terms. The thesis assesses the usefulness of A. Kopff’s conception of layered structure of the works for the legal evaluation of derived creations. The thesis further elaborates on the subjects of co-authorship of literary translation and plagiarism of translations. The noteworthy notion of auto-translation and associated legal problems are also analysed in the thesis.
