Rynek odnawialnych źródeł energii - węzłowe problemy regulacyjne.

The main objective of this MA thesis is to present the most characteristic elements of the renewable energy market and its current problems. At the beginning, the notion of the internal energy market, its development, and its core assumptions will be presented. In the second chapter the author analyses the issue whether electricity is to be considered in the category of goods or rather services of general interest. A point of departure for this analysis is to examine the notion of the complex service, which consists of the contract of sale and the agreement on provision of services or their distribution. The third chapter will be devoted to the licensing obligation and the exceptions from it. The issue of productive units connection to the network, the conditions to be met by the entities demanding the connection and the obligations of the network operator are discussed in the next chapter. The last chapter concerns support systems for renewable sources, especially that applied in the Polish law. The entities obliged to the acquisition of so called green certificates and the matter of their trade on Polish Power Exchange are also described in the chapter.

Założeniem pracy jest przedstawienie najbardziej charakterystycznych elementów rynku odnawialnych źródeł energii oraz jego aktualnych problemów. Na początku przedstawione zostanie pojęcie wewnętrznego rynku energii, kolejne etapy jego powstawania oraz jego najważniejsze założenia. W drugim rozdziale autor rozstrzygnie kwestię, czy energia elektryczna jest towarem, czy też usługą użyteczności publicznej. Punktem wyjścia dla tego rozważania będzie usługa kompleksowa, która zawiera w sobie umowę sprzedaży oraz umowę o świadczenie usług przesyłania lub dystrybucji. Rozdział trzeci zostanie poświęcony obowiązkowi koncesyjnemu oraz wyjątkom od tego obowiązku. W rozdziale czwartym zostanie opisana kwestia przyłączenia jednostek wytwórczych do sieci, przesłanki jakie muszą spełnić podmioty domagające się przyłączenia oraz obowiązki operatorów wobec tych podmiotów. Ostatni rozdział będzie dotyczył systemów wsparcia dla odnawialnych źródeł energii, a w szczególności system obowiązujący w polskim prawie. Wskazane również zostaną podmioty, które są zobligowane do kupna tzw. zielonych certyfikatów, a także zagadnienie handlu owymi certyfikatami na Towarowej Giełdzie Energii.
