Shaping the relationship between the Court of Justice of the European Union and the European Court of Human Rights in the context of the accession of the European Union to the Convention of Human Rights and Fundamental Freedoms.

The legal basis for the accession of the European Union to the European Convention of Human Rights was established in the Treaty of Lisbon. The result of the accession negotiations was a draft of an agreement that will be subject to opinion of the CJEU.This paper analyzes the relationship between the CJEU and the ECHR. The key issues that will be discussed in this paper are the procedure enabling the CJEU to assess the compatibility of EU law with the Convention rights - prior involvement, the principle of the autonomy of EU law, and the future of the Bosphorus doctrine after the accession.

Dzięki zmianom wprowadzonym Traktatem z Lizbony akcesja Unii Europejskiej do Europejskiej Konwencji Praw Człowieka stała się prawnie możliwa. Po ukształtowaniu postanowień umowy akcesyjnej kolejnym krokiem - na drodze do akcesji - jest zaopiniowanie jej przez TSUE. Niniejsza praca ma na celu omówienie zagadnień związanych ze wzajemnymi stosunkami pomiędzy Trybunałami; w szczególności projektowanego w umowie akcesyjnej mechanizmu prior involvement, kwestii zachowania autonomii prawa europejskiego oraz przyszłości doktryny Bosphorus po przystąpieniu Unii Europejskiej do EKPC.
