The Law of the Sea under the regime of United Nations Convention on the Law of the Sea: selected issues

The 1982 UN Convention on the Law of the Sea has played an important role in bringing order to the oceans, in particular by laying down a clear and universal framework in many aspects of the law of the sea. However, in some parts the Convention, unsurprisingly, turned out to be not as successful as it was originally anticipated and these “failures” and shortcomings are the main subject of this thesis. Because of the limited space of this work it was vital to carefully choose which issues should be presented and which were of particular significance in the last 30 years. In consequence, this thesis focuses on three problems, namely: piracy, terrorism at sea and the principle of common heritage of mankind.

Konwencja NZ o prawie morza z 1982 roku odegrała wielką rolę we wprowadzeniu porządku prawnego dla mórz i oceanów, w szczególności poprzez ustanowienie jasnego i uniwersalnego reżimu prawnego w wielu aspektach prawa morza. Jednakże, w pewnych kwestiach Konwencja z Montego Bay okazała się niewystarczająca i te "porażki" oraz niedociągnięcia są głównym tematem niniejszej pracy. Ze względu na ograniczoną pojemność pracy magisterskiej, konieczne było dokładne i staranne wybranie oraz przedstawienie problemów, które były najbardziej znaczące w ostatnich 30 latach. W związku z powyższym, niniejsza praca skupia się na trzech fundamentalnych zagadnieniach, tj.: piractwie, terroryzmie na morzu oraz na zasadzie wspólnego dziedzictwa ludzkości.
