Supervision over territorial self-government in Poland in the years 1933-1939

Zasadniczym tematem pracy jest problematyka instytucji nadzoru sprawowanego nad samorządem terytorialnym w Rzeczypospolitej w drugiej połowie dwudziestolecia międzywojennego, zaś celem napisania pracy jest ukazanie ewolucji nadzoru, próba jego zdefiniowania oraz określenie jego miejsca w porządku prawnym wprowadzonym przez Ustawę Scaleniową z 1933r. i nową konstytucję z 1935r. Praca złożona jest z dwóch rozdziałów. Rozdział pierwszy wyjaśnia pojęcie samego nadzoru, gdyż warunkiem podjęcia się szczegółowych rozważań na temat nadzoru sprawowanego nad samorządem terytorialnym jest właściwe rozstrzygnięcie kwestii terminologicznych, które dotyczą tego zagadnienia. W rozdziale drugim, określone zostały jego cele nadzoru, podmioty oraz kryteria ustroju władzy nadzorczej, a także scharakteryzowane zostały środki nadzorcze występujące w polskim porządku prawnym drugiej połowy dwudziestolecia międzywojennego, ze szczególnym zwróceniem uwagi na rozwiązania wprowadzone przez ustawę scaleniową i konstytucję kwietniową. Praca ta ma charakter historyczno – prawny i oparta jest na analizie źródeł pod postacią ustaw pochodzących z okresu dwudziestolecia międzywojennego.

The subject of the work is the problem of the supervisory authority exercised over the territorial self-government in the Commonwealth in the second half of the interwar period, and the purpose of writing the work is to illustrate the evolution of supervision, to define it and to define its place in the legal order introduced by the 1933 Combined Act. And the new constitution of 1935. The work consists of two chapters. The first chapter explains the notion of supervision itself, as a thorough consideration of the terminology that is relevant to this issue is a prerequisite for taking detailed consideration of the oversight of the local government. In chapter two, its objectives of supervision, entities and criteria of supervisory authorities were defined, as well as the supervisory measures in the Polish legal system of the second half of the interwar period, with special attention paid to the solutions introduced by the amalgamation law and the April Constitution. This work is of historical and legal character and is based on the analysis of sources in the form of laws dating back to the interwar period.
