The concept of financial instrument in capital market law

The aim of the thesis is to evaluate the concept of financial instrument in the capital market law. The main object of research is the catalogue of financial instruments included in MiFID II. The thesis presents the functions of financial instruments as well as the functions of the concept of a financial instrument itself. An analysis of financial instruments covered by the above-mentioned catalogue was also carried out. The European solutions were also evaluated in the light of emerging problems and challenges. After analyzing current European and US solutions, as well as related problems, it was also suggested to introduce amendments that may contribute to optimizing the catalog of financial instruments.

Zadaniem pracy jest ocena pojęcia instrumentu finansowego, która funkcjonuje w prawie rynku kapitałowego. Głównym obiektem badań jest katalog instrumentów finansowych, który zawiera MiFID II. W pracy przedstawione zostały funkcje instrumentów finansowych, a także funkcje samego pojęcia instrumentu finansowego. Przeprowadzono także analizę poszczególnych instrumentów finansowych objętych wspomnianym katalogiem. Dokonano także oceny rozwiązań europejskich w świetle pojawiających się problemów oraz wyzwań. Po analizie obecnie obwiązujących rozwiązań europejskich oraz amerykańskich,a także związanych z nimi problemów zaproponowano również wprowadzenie zmian, które mogą przyczynić się do zoptymalizowania katalogu instrumentów finansowych.
