Handing over the real estate into permanent management

Niniejsza praca dotyczy instytucji trwałego zarządu jako prawnej formy władania nieruchomością państwową lub samorządową przez państwową lub samorządową jednostkę organizacyjną nieposiadającą osobowości prawnej. Praca ma na celu usystematyzowanie wiedzy na temat instytucji trwałego zarządu. W pracy magisterskiej, przy uwzględnieniu dorobku doktryny oraz judykatury, została podjęta próba ustalenia charakteru trwałego zarządu. W pracy poruszona została również problematyka konstytucyjnej ochrony własności z uwagi na to, iż trwały zarząd nie powoduje przeniesienia własności nieruchomości na jednostkę organizacyjną nieposiadającą osobowości prawnej. Ważną częścią niniejszej pracy jest również scharakteryzowanie zasad wiążących się z ustanowieniem trwałego zarządu oraz jego wygaśnięciem. Przy omawianiu skutków wygaśnięcia trwałego zarządu została poruszona problematyka ochrony osób trzecich, które w trakcie trwania trwałego zarządu, zawarły umowy z trwałym zarządcą.

This thesis concerns the institution of permanent management as a legal form of possession of state or self-government real estate by a state or self-government organizational unit without legal personality. The aim of the thesis is to systematize knowledge about the institution of permanent management. In the thesis, an attempt was made to establish the nature of permanent management. The subject of the constitutional protection of property was discussed in the thesis due to the fact that permanent management does not transfer ownership to an organizational unit without legal personality. An important part of this thesis is also the characterization of the rules related to the establishment of permanent management and its expiry, taking into account the protection of third parties who concluded an agreement with the permanent manager during the permanent management was raised.
