Zamówienia publiczne - wybrane aspekty. Zamówienia publiczne w dobie pandemii COVID-19

Celem pracy magisterskiej jest analiza system zamówień publicznych w Polsce w ostatnich latach. Zamówienia publiczne pełnią znaczącą rolę w wymianie dóbr i usług oraz realizują cel optymalnego wydatkowania środków publicznych przez co stanowią istotny element polityki gospodarczej. W pierwszym rozdziale przedstawiono cele regulacji zamówień publicznych, dane dotyczace rynku, zasady,progi kwotowe zamówień publicznych.W rozdziale drugim wskazano na zasady zamówień publicznych. Rozdział trzeci zawiera opisy trybów zamówień publicznych obecnie obowiązującychw Polsce. W rozdziale kolejnym zwrócno uwagę na najważniejsze dokumenty w postępowaniu o udzielenie zamówień publicznych oraz sposób ujmowania tematyki funkcji prawa zamówień publicznych. Ostatni rozdział zawiera analizę wpływu pandemii COVID-19 na obecny proces postępowań dotyczących zamówień publicznych, wskazuje, kiedy i w jakich sytuacajch poszczególne podmioty mogą zostać zwolonione ze stosowaniu ustawy Prawo zamówień publicznych i jakim restrykcjom wobec powyższego podlegają. Zwrócono także uwagę, iż w roku 2021 w życie wchodzi nowelizacja wyżej wspomnianej ustawy, dlatego w powyższym opracowaniu zawarto również podsumowanie funkcjonowania ustawy w ostatnich latach.

The aim of this master's thesis is to analyze public contracts in Poland in recent years. Public contracs are concluded between the purchaser and the contractor, which apply to the supply, services and construction works. They have a significant role in the exchange of goods and services and realize the goal of optimal spending of public funds, presents the objectives of public procurement regulations as well as the manner of capturing the subject matter of public procurement law. The first chapter presents the objectives of public procurement regulation, market data, rules and thresholds of public procurement amounts, whereas the second chapter presents the principles of public procurement. The third chapter contains descriptions of the currently applicable public procurement procedures. In the next chapter, attention is drawn to the most important documents in the public procurement award procedure and the way of framing the subject of the public procurement law function. Last chapter includes analize of impact od COVID-19 pandemic on on the current process of public procurement procedures, indicates when and in what circumstances individual entities may be exempted from the application of the Public Procurement Law and to what restrictions they are subject to. It should also be noted that in 2021 an amendment to the above-mentioned act comes into force, therefore the above study also includes a summary of the functioning of the act in the first few years.
