"An ethical denunciations era in Poland"? : socio-legal aspects of whistleblower action

Celem artykułu jest przede wszystkim próba odpowiedzi na następujące pytanie: Czy istnieje realna możliwość wprowadzenia whistleblowingu w Polsce oraz na jaki zakres ochrony mogliby liczyć "etyczni donosiciele"? Autorka przedstawia pojęcie whistleblowingu oraz uregulowania prawne w krajach o długiej tradycji ochrony "etycznych donosicieli". Dokonuje również analizy poziomu ochrony whistleblowers w krajach systemu prawa common law. Ponadto, wskazuje kierunek, jaki powinny obrać polskie przepisy w zakresie ochrony whistleblowers.

The purpose of this article is primarily an attempt to answer the following questions: Is there a real possibility of whistleblowing in Poland, and on what scope of protection could the "ethical informers" count? The author presents the concept of whistleblowing and legal regulations in the countries with a long tradition of protection of "ethical informers". She also performs an analysis of the level of whistleblower protection in the countries of the common law system. Moreover,the author indicates the direction which the Polish regulations on the protection of whistleblowers should take.
