Electronic public procurement : current status and trends

The European Union decided to apply e-procurement solutions in all European public procurement system. This resolution requires many adjustments to both European and Polish legal systems. It is important to prepare effective legislation to implement EU directives. It is also required to prepare a project of specific electronic system for public procurement in Poland. There is no time to spare, because there is tough deadline to create this legislation, and political problems in Poland didn't make it easier. The author describes current Polish and European legislation and process of preparation new projects for e-procurement. In this article there are also presented many advantages and disadvantages of planned by Polish Public Procurement Office legal and technical problems resolutions.

Unia Europejska zadecydowała o zastosowaniu rozwiązań określanych jako e-zamówienia w całym europejskim systemie zamówień publicznych. Zmiany te wymagają dostosowania zarówno unijnego, jak i polskiego systemu prawnego. Najważniejszym etapem jest przygotowanie implementacji unijnych dyrektyw do polskiego systemu prawnego. Równie ważne będzie przygotowanie projektu specjalnego systemu elektronicznego do obsługi zamówień publicznych w Polsce. Nie ma czasu do stracenia, gdyż terminy do implementacji są bardzo napięte, a sytuacja polityczna w Polsce jak dotąd nie ułatwiała tych zmian. Autor opisuje obecny stan polskiej i unijnej legislacji oraz proces przygotowania nowych projektów na potrzeby e-zamówień. W artykule zostaną także zaprezentowane liczne zalety i wady rozwiązań prawnych i technicznych przygotowywanych przez polski Urząd Zamówień Publicznych.
