Odpowiedzialność za wykroczenia w zakresie obowiązku przestrzegania zasady tworzenia tzw. "korytarza życia"

W publikacji zaprezentowano najważniejsze założenia nowelizacji art. 9 ustawy z dnia 20 czerwca 1997 r. - Prawo o ruchu drogowym (tekst jedn. Dz. U. z 2018 r., poz. 1990 ze zm.) i nowej instytucji, jaką jest obowiązek prawny tworzenia tzw. "korytarza życia”, a także konsekwencji niestosowania się przez kierujących do nowych przepisów. Rozważania na gruncie prawa wykroczeń podjęto z uwzględnieniem dorobku doktryny i orzecznictwa wypracowanych w realiach porządku prawnego przed 6 grudnia 2019 r.

The publication presents the most important assumptions of the amendment to art. 9 of the Act of June 20, 1997. - Road traffic law (consolidated text, Journal of Laws of 2018, item 1990, as amended) and a new institution which is the legal obligation to create the so-called "Corridor of life”, as well as the consequences of non-compliance by those referring to the new regulations. Considerations under the law of offenses were undertaken taking into account the achievements of doctrine and case law developed in the realities of the legal order before December 6, 2019.
