W artykule przedstawiono problemy geodezyjno-prawne powstające w toku realizacji przepisów znowelizowanej ustawy z 10 kwietnia 2003 r. o szczególnych zasadach przygotowania i realizacji inwestycji w zakresie dróg publicznych. Do wniosku o wydanie decyzji o zezwoleniu na realizację inwestycji drogowej należy dołączyć dokumentację geodezyjną sporządzoną w celu zatwierdzenia podziałów deodezyjnych nieruchomości, ustalenia stanu prawnego nieruchomości przeznaczonych pod inwestycje drogowe oraz ujawnienia w księdze wieczystej nabycia prawa własności przez podmioty publicznoprawne. Autorki przedstawiają praktyczne problemy geodezyjno-prawne powstające w toku przygotowania wyżej wymienionej dokumentacji oraz znaczenie prawidłowego wykonania tej dokumentacji dla potrzeb ustalenia odszkodowania dla właścicieli nieruchomości.

The article present geodetic and legal problems arising during the implementation of the regulations of the amended law of 10th April 2003 on particular rules of the preparation and implementation of investment in public roads. The application for the permission of the implementation of a road investment should be supplemented with the geodetic documentation made to confirm the geodetic divisions, establish the legal state of the real estate and put into the land register the fact of acquiring the property rights by public bodies. The autors present practical geodetic and legal problems arising during the preparation of the mentioned above documentation and the significance of a proper making of such documentation for the needs of establishing the compensations for the property owners.
