Refleksja i działania Kard. Josepha Ratzingera wobec niemożliwości udzielania święceń kobietom. Wybrane kwestie teologiczno-prawne

The problem of the impossibility of ordaining women was extensively clarified by the Congregation for the Doctrine of the Faith in 1976 in the declaration Inter insignores, but after the publication of this document the discussion was not closed, and there were claims that the question was still open. It was therefore necessary for the papal teaching office to intervene in order to clarify the matter. However, this issue was also subject of further discussion and various kinds of conundrums. Thus, Cardinal Joseph Ratzinger’s reflection on this question is not only to emphasise that the Church cannot transcend the boundaries that constitute its constitutive elements, since it has no such authority. On the other hand, the theological foundations of the various categories of truth are translated into their normative and disciplinary provisions in canon law. Therefore, the article addresses the dependence of Cardinal Ratzinger’s theological reflection and its consequences in the universal legislation of the Church.

Problem niemożliwości święcenia kobiet został obszernie wyjaśniony przez Kongregację Nauki Wiary w 1976 r. poprzez deklarację Inter insignores, jednak po ukazaniu się tego dokumentu dyskusja nie została zakończona, co więcej pojawiały się głosy, że kwestia ta jest nadal otwarta. W związku z tym, okazała się konieczna interwencja papieskiego Urzędu Nauczycielskiego, aby tę kwestię przedstawić w sposób ostateczny. Jednakże i ta kwestia poddana była dalszym dyskusjom i różnego rodzaju konstatacjom. Dlatego też refleksja kardynała Josepha Ratzingera nad tym zagadnieniem stanowi nie tylko podkreślenie, iż Kościół nie może przekroczyć granic, które stanowią jego konstytutywne elementy, ponieważ nie ma takiej władzy. Natomiast teologiczne podstawy poszczególnych kategorii prawd przekładają się na ich normatywne oraz dyscyplinarne zapisy w prawie kanonicznym. Stąd też artykuł podejmuje kwestię zależności refleksji teologicznej kardynała Ratzingera i jej konsekwencje w prawodawstwie powszechnym Kościoła.
