Prawo i bezpieczeństwo w kontekście zwrotu biopolitycznego
The main purpose of this article is to describe a general tendency to diminish the role of the law and simultaneously growth of the importance of the security in resolving social and political issues. For the start point of our consideration we employ a principle and policy distinction drawn by Ronald Dworkin. The next category which we are going to face is security which is a crucial issue in contemporary relation between the law and the policy. The field of our investigation is related to the state level as well as the international level. The redefinition of category of distributive justice and citizenship in biopolitical approach are the final points of this paper. The main thesis is: dynamics of social and technological changes leads to marginalization of the law and the legal guaranties and to supremacy of strict biopolitical solutions what is revealed in issues of security, especially in the security of the population.
