The establishment and evolution of the Ombudsman for Children in Poland

The object of study in this thesis is an institution of the Ombudsman for Children in Poland. For the 12 years the Ombudsman for Children's operational model has evolved. Initially it was a subsidiary body in relation to the Ombudsman of human rights with a less competences. After the changes in law it is an independent body now with a broad package of competences. The author of this thesis describes both models and comparing the functioning of the Children's Ombudsman and the Ombudsman. Moreover the Ombudsman for Children is also analysed of his activity with emphasis on its effectiveness before and after such changes in the act.

Przedmiotem niniejszej pracy jest instytucja Rzecznika Praw Dziecka w Polsce. W ciągu 12 lat działalności Rzecznika nastąpiła istotna ewolucja jego modelu funkcjonowania. Początkowo był to organ subsydiarny w stosunku do Rzecznika Praw Obywatelskich, posiadający niewiele kompetencji. Obecnie zaś, po przeprowadzonych zmianach, jest to organ samodzielny, o szerokim pakiecie uprawnień. Autorka w niniejszej pracy zajmuje się omówieniem obu modelów funkcjonowania oraz porównaniem Rzecznika Praw Dziecka i Rzecznika Praw Obywatelskich. Ponadto dokonano również analizy działalności dziecięcego Ombudsmana, ze szczególnym uwzględnieniem jego skuteczności przed i po przeprowadzonych zmianach w ustawie.
