Standardy wykonywania kary pozbawienia wolności

The subject of this study is to analyse some of the most important international and national legal standards concerning the treatment of persons deprived of their liberty. At the beginning, author presents international documents including the principal rules governing the treatment of persons deprived of their liberty and deal with the notion of torture, cruel, inhuman and degrading treatment and punishment. In the further part author try to compare national and international regulations connected with rights and duties of persons who serving a sentence of imprisonment. The following chapter consider aspects of detention such as accommodation, the health of prisoners, their contacts with the outside world through visits and correspondence. The last chapter pertain strictly to  international and national institutions which are establishment for controlling to observe the rules by  penal institutions. At the end author bring up to problems of polish penal institutions such as overcrowding, problems with , and sanitary conditions.

Celem niniejszego opracowania jest próba porównania norm oraz zaleceń prawa międzynarodowego  dotyczących standardów wykonywania kary pozbawienia wolności z przepisami polskiego prawa oraz praktyką funkcjonowania skazanych w jednostkach penitencjarnych. Pierwszy rozdział poświęcony został międzynarodowym dokumentom dotyczącym  praw osób pozbawionych wolności. Drugi rozdział opisuje mechanizm wdrażania norm prawa międzynarodowego do wewnętrznego porządku prawnego oraz moc ich obowiązywania. W kolejnym rozdziale przytoczono przepisy Konstytucji odnoszące się do praw osób pozbawionych wolności oraz opisano podstawowe prawa i obowiązki skazanych w kontekście norm prawa międzynarodowego oraz krajowego. Rozdział czwarty charakteryzuje międzynarodowe oraz krajowe mechanizmy kontrolne, wskazując na istotną rolę kontroli pozasądowej. Przedstawiono ponadto problemy polskich placówek penitencjarnych dostrzeżone przez sądowe oraz pozasądowe mechanizmy kontrolne, funkcjonujące w ramach Organizacji Narodów Zjednoczonych, Rady Europy, Unii  Europejskiej oraz Krajowego Mechanizmu Prewencji.
