Legal analysis of a construction contract based on the example of contract for the reconstruction, renovation and modernization of the MOSiR stadium in Mielec

The main purpose of this master’s thesis is to present general legal circumstances relating to construction contracts and to discuss solutions adopted in the analyzed agreement. The master’s thesis presents the legal regime that apply to the analysed contract, as well as objective and subjective scope of the contract. Liability for the defects in the work, the role of the contract performance bond, the admissibility of amendments to the agreement and the institution of subcontracting were discussed in separate parts.

Celem niniejszej pracy jest przedstawienie ogólnego stanu prawnego dotyczącego umów o roboty budowlane oraz omówienie rozwiązań przyjętych w omawianej umowie. W pracy przedstawiony został reżim prawny, jaki miał zastosowanie przy zawieraniu analizowanej umowy, a także zakres przedmiotowy i podmiotowy umowy. W oddzielnych częściach została omówiona odpowiedzialność za wady obiektu budowlanego, rola zabezpieczenie należytego wykonania umowy, dopuszczalność zmian umowy oraz instytucja podwykonawstwa.
