The influence of the final judgment of the court of arbitration on the ongoing proceeding before the other court of arbitration

Zasada związania prawomocnie uznanym wyrokiem sądu arbitrażowego przez inny sąd arbitrażowy jest zagadnieniem budzącym spore kontrowersje. Celem niniejszej pracy jest zbadanie czy zasada ta obowiązuje w prawie arbitrażowym czy też nie. W pierwszym rozdziale przedstawiono pojęcia, wskazując podstawowe teorie prawa arbitrażowego, skutki wyroku w procedurze cywilnej. Wskazano charakter wyroku sądu arbitrażowego i instytucje uznania tegoż wyroku przez sąd powszechny. Rozdział drugi i trzeci prezentuje koncepcje związania i braku związania prawomocnie uznanym wyrokiem sądu arbitrażowego wraz z argumentacją. W zakończeniu przedstawiono stanowisko własne autorki.

The influence of the final judgment of the court of arbitration on the ongoing proceeding before the other court of arbitration is controversial issue. The aim of this master thesis is to check if this rule is working in arbitration law or not. The first chapter provides the explanations of the terms used in this thesis, indicates the basics arbitrations' theories, shows the effects of the final judgment in civil procedure. The thesis indicates also the nature of the judgment of the court of arbitration and the institution of acknowledge the final judgment of the court of arbitration by the general court. The second and the third chapter show two different conceptions of the influence of the final judgment of the court of arbitration on the ongoing proceeding and the lack of the influence in this issue with argumentation. The summarize provides the position of its own author.
