Wpływ religii na prawo spadkowe w Rzymie oraz w zachodniej tradycji prawnej

Celem pracy jest przedstawienie wpływu wyobrażeń religijnych na kształtowanie systemów prawa spadkowego w Rzymie oraz w zachodniej tradycji prawnej do XVIII wieku. Praca składa się z 6 rozdziałów. Pierwszy z nich to opis pojęcia prawa i religii oraz przybliżenie terminu zachodniej tradycji prawnej. Kolejne trzy rozdziały dotyczą wpływu religii rzymskiej na system dziedziczenia od czasów archaicznych aż do Justyniana. Następnie omówione zostało oddziaływanie wierzeń plemion germańskich na szczepowe prawo spadkowe. Ostatni rozdział dotyczy roli jaką w kształtowaniu nowożytnych systemów prawna spadkowego odegrała religia chrześcijańska i prawo kanoniczne.

The main purpose of this thesis is to investigate the influence of the religious ideas on the development of the inheritance law in Rome and in the Western Legal Tradition till the XVIII century. The thesis contains 6 chapters. The first one presents the notions of law, religion and Western Legal Tradition. The next three chapters concern the influence of the Roman religion on the inheritance law from the archaic times to the Justinian's era. Furthermore, there was presented the impact of the religious ideas of the German tribes on the tribal system of the inheritance law. The last is to emphasize the role that has been played by the Christianity and the Canon Law in the development of the modern inheritance law systems.
