Crime of women and motherhood in prisons

The aim of this dissertation is to present the issue of crimes committed by women along with the execution of a sentence of imprisonment against the perpetrators of crimes. Considerations begin to present basic definitional issues, together with historical and criminological theories explaining the phenomenon of women’s crimes. Furthermore, the fundamental human rights and freedoms entitled to every man were quoted, as well as international standards of conduct with women, influencing national legislation. The normative part of this thesis includes the most important regulations concerning enforcement of the sentence against the perpetrators of crimes. The remaining part of the dissertation mainly focuses on the issue of motherhood. Therefore, the normative regulations and the practice of imprisonment against pregnant women and mothers of prisoners were presented. Additionally, the work includes practical solutions for dealing with perpetrators who require special treatment, examples of the impact of integration and analysis of statistical data on women’s crime in the last decades.

Przedmiotem niniejszej pracy magisterskiej jest problematyka przestępczości kobiet oraz wykonywania kary pozbawienia wolności wobec sprawczyń przestępstw. Rozważania rozpoczyna przedstawienie podstawowych zagadnień definicyjnych, rysu historycznego oraz teorii kryminologicznych wyjaśniających zjawisko przestępczości kobiet. Następnie przytoczone zostały podstawowe prawa i wolności przysługujące każdemu człowiekowi, również osobie pozbawionej wolności oraz międzynarodowe standardy postępowania z kobietami, wpływające na ustawodawstwo krajowe. Część normatywna zawiera najważniejsze regulacje w zakresie wykonywania kary wobec sprawczyń przestępstw. W dalszej części pracy szczególna uwaga poświęcona została zagadnieniu macierzyństwa. Zaprezentowane zostały regulacje normatywne oraz praktyka wykonywania kary pozbawienia wolności wobec kobiet ciężarnych oraz skazanych matek. Ponadto praca zawiera rozwiązania praktyczne w zakresie postępowania ze sprawczyniami wymagającymi specjalistycznego oddziaływania, przykłady oddziaływań integracyjnych oraz analizę danych statystycznych dotyczących przestępczości kobiet w ostatnim dziesięcioleciu.
