Compensation for the damage suffered by persons indirectly harmed

Praca porusza problem skutków nowelizacji art. 446/4 k.c. na dwóch, uzupełniających się płaszczyznach. Po pierwsze analizuje problem relacji między art. 446/4 k.c. a art. 446/3 k.c. z uwzględnieniem bogatego orzecznictwa, które w drodze szerokiej wykładni przepisu mówiącego o stosownym odszkodowaniu uwzględniało pewne elementy niemajątkowe dla odszkodowania. Po drugie analizuje problem dobra osobistego w postaci więzi rodzinnej zarówno pod kątem samej możliwości jego wykreowania jak i pod kątem skutków, które ma zaakceptowanie takiego dobra osobistego.

This dissertation deals with a problem of the amendment of art. 446/4 of the Polish Civil Code in two ways. Firstly, it analyzes the problem of the relation between art. 446/4 k.c. and art. 446/3 k.c. taking into account the abundant case-law which by broad interpretation of a provision referring to the appropriate compensation took into account certain nonmaterial damage for compensation of material damage. Secondly, it examines the problem of considering family ties a personal good both in terms of possibility of creating such personal good and in terms of consequences of accepting such a personal good.
