Europejska współpraca administracyjna
The article discusses the legal structure of European administrative cooperation, introduced relatively recently to the Polish Code of Administrative Procedure, contained in chapter VIIIa of this legal act. The scope of the analysis is not limited to only procedural issues, however, and the regulation of Polish law is treated in principle as an emanation of European law. The analysis begins with establishing the legal basis for European administrative cooperation – both in the context of the general regulations of primary law of the European Union and more detailed indications of secondary law. In order to outline the normative shape of the structure, further considerations focus respectively on the subject and object plane of the structure (the goals of the legislator in its regulation and forms of cooperation). The second part of the article examines the proper regulation of the Code of Administrative Procedure regarding European administrative cooperation.
