The scope of the concept of public information and selected problems of access to public information in the light of the jurisprudence of administrative courts

Głównym problemem badawczym pracy jest identyfikacja zakresu pojęcia informacji publicznej oraz innych problemów dostępu do informacji publicznej na podstawie analizy orzeczeń sądów administracyjnych. Postawione hipotezy badawcze to szerokie ujmowanie pojęcia informacji publicznej w orzecznictwie sądowym oraz twierdzenie, że jest to gwarancja istnienia demokratycznego państwa prawnego. Analiza orzeczeń sądów administracyjnych ma na celu określenie zakresu przedmiotowego pojęcia informacja publiczna oraz identyfikację potencjalnych problemów pojawiających się przy rozpatrywaniu spraw z zakresu dostępu do informacji publicznej.

The main research problem of the paper is to identify the scope of the concept of public information and other problems of access to public information on the basis of analysis of administrative court decisions. The research hypotheses put forward are a broad grasp of the concept of public information in the judicial decisions and the claim that it is a guarantee existence of a democratic legal state. The analysis of rulings of administrative courts aims to define the material scope of the concept of public information and to identify potential problems that arise when considering cases of access to public information.
