The financial responsibility of the public officer for damages caused in connection with the exercising public authority

The guarantee of repairing damage caused in connection with the exercising public authority influence on increase citizens’ trust in the state. The basic element of the efficient functioning of the state is the proper system of clerical responsibility. The financial responsibility is the only part of it. The purpose of this thesis is the analysis of the legal regulations related to this issue, include in legal acts, which are valid in Poland and the comparison of the solutions include in legal regulations of other Member States. The considerations begin with the characteristics of financial responsibility as well as the analysis of the regulations of this issue, which include in the Civil Code, in the Labor Code and in the Penal Code. The next chapter presents the solutions implemented in the legal systems of selected Western European countries – in Germany, in France and in the UK. The final chapter contains the analysis of the act of 20 January 2011 about financial responsibility of the public officials for gross violation of the law.

Gwarancja naprawienia szkody wyrządzonej przy wykonywaniu władzy publicznej wpływa na wzrost zaufania obywateli do państwa. Podstawowym elementem sprawnego funkcjonowania państwa jest właściwy system odpowiedzialności urzędniczej. Odpowiedzialność majątkowa stanowi jedynie jego część. Celem niniejszej pracy jest analiza przepisów prawnych dotyczących tej tematyki zawartych w regulacjach prawa polskiego oraz porównanie rozwiązań zawartych w regulacjach innych państw. Rozważania rozpoczynają się od przedstawienia charakterystyki odpowiedzialności majątkowej, a także od analizy regulacji tej problematyki, które zostały zawarte w Kodeksie cywilnym, w Kodeksie pracy oraz w Kodeksie karnym. Następny rozdział ukazuje rozwiązania wprowadzone w systemach prawnych w wybranych krajach Europy Zachodniej – w Niemczech, we Francji oraz w Wielkiej Brytanii. Ostatni rozdział zawiera analizę ustawy z dnia 20 stycznia 2011r. o odpowiedzialności majątkowej funkcjonariuszy publicznych za rażące naruszenie prawa.
