The anti-crisis collective agreements in the labour law

The master thesis refers to the issue of anti-crisis collective agreements in the labour law, which are reducing the employment’s conditions as a consequence of employer’s serious economic situation. Due to its exceptional nature, this type of agreement makes an association with the institution of rebus sic stantibus clause (article No. 3571 of the Civil Code). The thesis is a try to compare them.

Praca dotyczy problemu porozumień zbiorowych prawa pracy, których istotą jest tymczasowe obniżenie standardów zatrudnienia pracowników w związku z pogorszeniem się sytuacji finansowej pracodawcy (art. 91 k.p., art. 231a k.p., art. 24127 k.p.). Z uwagi na swój wyjątkowy charakter instytucja ta nasuwa skojarzenie z cywilistyczną klauzulą rebus sic stantibus (art. 3571 k.c.). Praca stanowi próbę ich porównania.
