Materialne i niematerialne dziedzictwo kulturowe w świetle konwencji UNESCO

Celem rozdziału jest zarysowanie problematyki dziedzictwa kulturowego, zarówno materialnego, jak i niematerialnego - w oparciu o Konwencję UNESCO w sprawie ochrony światowego dziedzictwa kulturalnego i naturalnego oraz Konwencję UNESCO w sprawie ochrony niematerialnego dziedzictwa kulturowego. W tekście zaprezentowane zostały geneza i cechy wspomnianych Konwencji UNESCO, definicje dziedzictwa kulturalnego oraz niematerialnego dziedzictwa kulturowego, system list tworzonych przez obie Konwencje, zagadnienia dotyczące pomocy międzynarodowej i organy konwencji. Omówiona została procedura wpisu na Listę Dziedzictwa Światowego oraz pojęcia takie, jak wpis seryjny, wpis transgraniczny, rozszerzenie wpisu, zmiana nazwy wpisu czy skreślenie wpisu. Scharakteryzowano także dziedziny, w których przejawia się niematerialne dziedzictwo kulturowe. Nie zabrakło niezbędnych odwołań do prawodawstwa polskiego, a przytaczane przepisy zostały zilustrowane stosownymi przykładami. Ponadto we wstępie krótko scharakteryzowano ONZ i UNESCO, a w podsumowaniu wymienione zostały podstawowe różnice pomiędzy omawianymi Konwencjami i wady tych dokumentów.

The aim of the chapter is to outline the problematics of cultural heritage, both tangible and intangible - according to the UNESCO Convention Concerning the Protection of the World Cultural and Natural Heritage and the UNESCO Convention for the Safeguarding of the Intangible Cultural Heritage. The text presents the genesis and characteristics of the mentioned acts, the definitions of cultural heritage and intangible cultural heritage, the lists system created by the two conventions, issues of international assistance and the organs of the conventions. The procedure of inscription on the World Heritage List is discussed, also concepts such as serial inscription, transboundary inscription, extension of an inscription, modification of a name or deletion of an inscription. There are also characterized domains in which intangible cultural heritage is manifested. The necessary references to Polish legislation were made, cited provisions were shown using relevant examples. In addition, in the introduction UN and UNESCO are briefly characterized, in the summary the main differences between the conventions and the disadvantages of these documents are listed.
