Individual complaint in defense of constitutional rights and freedoms

The study concerns the introduction into the Polish legal system of a new institution of "individual complaint for violation of constitutional rights or freedoms", which complements the constitutional complaint against a normative act, specified in Art. 79 of the Constitution of the Republic of Poland. Taking into account an individual complaint about the violation of constitutional rights or freedoms in criminal proceedings could lead to the court's refusal to apply a statutory norm if it would protect against such a violation. The study presents a draft amendment to the provisions of the Act taking into account such an institution.

Opracowanie dotyczy wprowadzenia do polskiego porządku prawnego nowej instytucji "indywidualnej skargi na naruszenie praw lub wolności konstytucyjnych", stanowiącej uzupełnienie skargi konstytucyjnej na akt normatywny, określonej w art. 79 Konstytucji RP. Uwzględnienie indywidualnej skargi na naruszenie praw lub wolności konstytucyjnych w postępowaniu karnym mogłoby prowadzić do odmowy stosowania przez sąd normy ustawowej, jeżeli miałoby to uchronić przed takim naruszeniem. Opracowanie prezentuje projekt zmiany przepisów ustawy uwzględniający taka instytucję.
