Fazy groomingu. Glosa do postanowienia Sądu Najwyższego z 17.03.2016 r., IV KK 380/15

In the critical gloss author points out that the Supreme Court failed to give a justification of his view on the interpretation of Article 200a § 2 of polish Criminal Code. The Supreme Court’s view is based on a selective interpretation of the constituent elements of Art. 200a § 2 of C.C. The gloss indicated that the right approach to the issue, on the basis of the case, is meticulous interpretation of two phases of grooming, based on the dogmatic and theoretical method of analysis, taking into account the phatic function of language (phatic communication), discussed in the philosophy of language.

W glosie krytycznej autor wskazuje, że Sąd Najwyższy nie uzasadnił w należyty sposób swego stanowiska w sprawie wykładni art. 200a § 2 k.k. Pogląd Sądu Najwyższego opiera się na wybiórczej interpretacji znamion omawianego przestępstwa. W glosie wskazano, że właściwym podejściem do omawianego zagadnienia, na gruncie omawianego stanu faktycznego, jest skrupulatna interpretacja obu faz groomingu w oparciu o metodę dogmatyczną i teoretyczną, w szczególności po uwzględnieniu wyróżnianej w nauce o języku tzw. fatycznej funkcji mowy.
