Kategorizace zákonů a volební zákon

This paper focuses on the interaction between statutory regulation of conflict of interests applicable to the electoral law and between electoral legislation. This paper deals with the question whether the regulation of incompatibility of functions as well as other restrictions aimed at deputies, senators and members of municipal and regional councils allows us to conclude that the regulation of conflict of interests is subjected to an obligatory consent of the Senate. This paper assumes that every law regulating elections regardless of how it is called should be perceived as electoral law. This article refuses the idea that the name of the statute should be decisive; according to the author the content of the statute is crucial. The fact that the consent of the Senate, according to the Art. 40 of the Constitution, is required must be obvious since the beginning not the outcome of a chance.

Článek se zabývá průnikem zákonné úpravy střetu zájmů do volebního práva a volebního zákonodárství. Otevírá otázku, zda úprava neslučitelnosti funkcí a další omezení pro poslance, senátory a členy zastupitelstev obcí a krajů, umožňuje zákon o střetu zájmů podřadit pojmu volební zákon, a tedy povinnému souhlasu Senátu. Článek vychází z materiálního hlediska, že volebním zákonem je každý zákon upravující volební právo bez ohledu na to, jak je nazván. Článek odmítá to, že by rozhodující měl být jen název zákona, ale je to jeho obsah. Přitom skutečnost, že je nutný povinný souhlas Senátu podle čl. 40 Ústavy, musí být zřejmá od počátku projednávání, a ne výsledek náhody.
