K pojmu, povaze a podobám neúzemní samosprávy - samospráva veřejných pojišťoven

The paper deals with the issue of non-territorial self-government. It includes not only the general characteristics of self-governmental institutions in the public administration of the Czech Republic but also the problem of the typology of public authorities in our contemporary and historical literature, while attempting to define characters possibly contributing to improving this typology. Theoretical explorations are subsequently confronted with examples of two subjects in which is by doctrine admitted (at least partly, but not the more clearly) the existence of certain self-governmental aspects. Chosen examined subjects are the General Health Insurance Company and the Czech Insurers’ Bureau as public institutions established by law in order to pursue specific activities in the field of public insurance (the choice of insurance companies was inspired by some texts of J.Prazak). The text is looking – by analyzing the legislation – at both these institutions for their eventual self-government elements and on the findings he attempts to classify them, respectively subsume them under some of the traditional categories of public administration bodies.

Příspěvek se věnuje problematice neúzemní samosprávy.Zabývá se nejen obecnými znaky samosprávných institucí ve veřejné správě České republiky, ale také problémem typologie veřejné samosprávy v naší soudobé i historické literatuře, přičemž se sám pokouší vymezit znaky, které by mohly přispět ke zpřesnění této typologie.Úvodní teoretické úvahy jsou následně konfrontovány s příklady dvou subjektů,u nichž i doktrína – přinejmenším částečně, tím spíše však ne zcela jednoznačně – připouští existenci určitých samosprávných aspektů. Zvolenými subjekty zkoumání jsou Všeobecná zdravotní pojišťovna a Česká kancelář pojistitelů coby veřejnoprávní instituce zřízené zákonem za účelem výkonu specifické činnosti v oblasti veřejných pojištění (volba pojišťoven byla inspirována některými texty J. Pražáka). Text za pomoci analýzy právní úpravy obou zmíněných institucí hledá jejich případné samosprávné prvky a na základě zjištěných poznatků se je pokouší klasifikovat, respektive subsumovat pod některou z tradičních kategorií subjektů veřejné správy.
