Prawne pojęcie gospodarstwa rodzinnego

Celem artykułu jest określenie poszczególnych elementów prawnej definicji rodzinnego gospodarstwa rolnego jako podstawy ustroju rolnego w Polsce. Przedmiotem analizy były przepisy Konstytucji RP i ustawy o kształtowaniu ustroju rolnego z 2003 roku. Rozważania prowadzą do krytycznej oceny obowiązujących rozwiązań. W końcowej części opracowania przedstawiono wnioski de lege ferenda.

The paper presents issues of legal regulation of the definition of family farm as the basis of the agricultural system in Poland. According to Article 23 of the Constitution of 1997 family homestead is the foundation of the Polish agrarian system. The analysis are the provisions of the Constitution and the Act on shaping the agricultural system which reveals current tendencies of the Polish agrarian system. The main aim of this paper was to identify individual elements of the legal definition of the family farm. Considerations lead to a critical assessment of the existing solutions. In the final part of the study presents the conclusions de lege ferenda postulates.
