This article defines the legal boundaries of civil liability of a mining company for damages in agricultural and forest lands in connection with operation of a mining plant, to the extent resulting from the Geological and Mining Law. The individual sections of this article pertain to the legal nature and principles of this liability, reasons for the restitution duty of mining companies as well as for other entities that may be responsible for the damage. The article also provides a detailed description of typical methods for repairing broadly-defined mining damage in agricultural and forest lands, to the extent of both the actual damage and the loss of profit caused by the damage. The article also discusses the issue of the burden of proof in the proceedings related to the reparation of mining damage and indicates extrajudicial settlement of disputes regarding mining damage.
