Implementacja przepisów Unii Europejskiej do krajowych wymagań eksploatacji maszyn i urządzeń w odkrywkowych zakładach górniczych

Artykuł opisuje proces konkretyzowania krajowych przepisów dotyczących urządzeń energomechanicznych w górnictwie odkrywkowym, przyjmując jako punkt wyjścia ustanowienie w 1989 r. przez Radę Wspólnot Europejskich dyrektyw w sprawie poprawy bezpieczeństwa i zdrowia w miejscu pracy oraz ujednolicenie wymagań dla maszyn w krajach członkowskich.

The legał reąuirements for machines in open pit mining in Poland has been amended repeatedly during the last decades. The article presents the implementation process of Polish legał acts regarding of open-pit mining machinery sińce 1954 until the present. The author describes changes which took place in health and safety regulations due to the use of minę mechanization works. These modifications were necessary in order to adjust and standardize to the European Union law regulations. The attention is paid especially to acts which have been introduced after the accession of Poland to the European Union in 2004. In particular, two of foremost directives are analyzed: Council Directive 89/391/EEC on the introduction of measures to improve the safety and health of workers at work and Council Directive 89/392/EEC on the approximation of the laws of a member of the State relating to machinery established by the Council European Communities. Both of them are fundamental to the current safety rules for using the machinery in open-pit mining in Poland.
