A public sector acquires vehicles of different kind, from vehicles for casual purposes like company cars and light commercial vehicles, to special vehicles like ambulances, fire trucks, police cars, buses, garbage trucks and street sweepers. The procurement procedures are regulated by the Public Procurement Low inter alia by the description of the subject the conditions of participation in the procedure, mode of the procedures, type of publication, selection award, conditions of the contract. It has become increasingly frequent that the public entities include the ecological requirements to their purchasing procedure. The analysis of public contracts for various means of transport in Poland in the recent years proves that open tender is the applied public procedure disregarding the value of the public contract and the offer only one criterion – price. Following the regulations of the European Union, on the 10th of May, 2011 the Prime Minister of Poland issued a regulation defining other obligatory criteria, beside price, for examination of the offers applying to the public contracts for purchases of vehicles from categories M and N. The most economically advantageous offer includes a combination of factors chosen by the contracting authority, including price, the consumption of energy, carbon dioxide emission and emission of pollutants (nitrogen oxides, dust particles and hydrocarbons). The paper attempts to assess the functioning of the system of public contracts regarding the consideration of environmental elements in awarding transport vehicles in the years 2009-2011.
