O możliwości udostępniania planów ruchu zakładów górniczych, w trybie ustawy o dostępie do informacji publicznej

Artykuł zajmuje się problematyką udostępniania planów ruchu zakładu górniczego oraz zawartych w nich informacji w trybie określonym przez ustawę z dnia 6 września 2001 r. o dostępie do informacji publicznej. Przybliża ponadto tematykę udostępniania powyższych informacji w trybie ustawy z dnia 3 października 2008 r. o udostępnianiu informacji o środowisku i jego ochronie, udziale społeczeństwa w ochronie środowiska oraz o ocenach oddziaływania na środowisko.

The article describes the possibility of making the mining plant operation plans available in the manner specified in the Act of 6 September 2001 on the access to public information. After the analysis of the essence of public information, the possibility of classifying mine operation plans to a category of information, information carrier and private document, the author concludes that the operation plans and their content, in principle, are not public information. A potential exception can be the operation plans of mining plants extracting minerals under mining ownership and some appendices to the operation plans. This statement is backed with an interpretation of the provisions of the act on the access to public information, court decisions and doctrine views. Due to the discrepancies regarding the interpretation of the provisions of the Act, the text also presents judicial decisions indicating the possibility of defending a position contrary to the one presented in the article. In addition, the article proposes that operation plans, in principle, are not considered information about the environment and its protection, although their contents may constitute such information. The method of denying access to mining plant operation plans is discussed in the article.
