System Ksiąg Wieczystych w Polsce - analiza stanu istniejącego w aspekcie przepływu informacji o terenie i tworzenia katastru nieruchomości

Praca zawiera analizę stanu istniejącego systemu Ksiąg Wieczystych w Polsce zasadniczo w dwóch aspektach. Pierwszym z nich jest przepływ informacji o terenie, drugim zaś jest tworzenie systemu katastru nieruchomości. Przedstawiono tu także rys historyczny funkcjonowania systemu Ksiąg Wieczystych w Polsce. Szczególną uwagę w artykule położono na uwarunkowania organizacyjne, technologiczne i prawne tworzenia katastru nieruchomości. W analizie systemu Ksiąg Wieczystych uwzględniono także problem przepływu informacji o terenie pomiędzy systemem Ewidencji Gruntów i Budynków i systemem Ksiąg Wieczystych. Przepływ informacji ma istotne znaczenie dla właściwego funkcjonowania obydwu systemów. W zakończeniu i wnioskach przedstawiono podstawowe założenia dla utworzenia systemu katastru nieruchomości. Choć założenia te podano dla systemu idealnego, to jednak niektóre z nich mogą być aktualnie wprowadzone. Dotyczy to zwłaszcza definicji podstawowego obiektu systemu.

The paper contains analysis of up-to-date conditions of Land Register system in Poland, fundamentally in two aspects. The first is terrain information flow, the second is real estate cadastre creating. A historical outline of running the Land Register system in Poland has been also presented. Special attention has been paid to the organisational, technological and legal conditions of creating real estate cadastre. In the Land Register system analysis, took also into consideration the problem of flowing terrain information between the Ground Cadastre and Land Register systems. This flow information has significant meaning for proper running of both systems. In the conclusion of the paper, some basic proposals concerning problem of creating real estate cadastre have been presented. Although these proposals have been given for ideal system, some of them may be applicated. It concerns especially the definition of the system basic object.
