Administrative proceedings conducted by the building supervision authority (part 2)

The purpose of this article is to present the amendment to the Construction Law, effective as of 19 September 2020, which introduced Articles 53a and 72a to the Construction Law, according to which proceedings for violations of the Construction Law, i.e. in cases of self-construction and in cases of maintenance of buildings, are initiated ex officio. This article is a continuation of the subject matter undertaken in the journal Construction and Law No. 4/2022. In this paper, the author, noting that the legislator has excluded the principle of complaint in these proceedings, argues that nowadays proceedings conducted by the construction supervision authorities in the cases specified in Articles 53a and 72a should be initiated only ex officio.
