W artykule omówiono zagadnienie kwalifikacji do wykonywania czynności kierownictwa i dozoru ruchu odkrywkowych zakładów górniczych w świetle przepisów prawa geologicznego i górniczego. Przedstawiono wymagania w zakresie kwalifikacji, podmioty właściwe do sprawdzenia ich posiadania oraz sam proces sprawdzania.

In the light of the applicable provisions of the geological and mining law, performing activities in opencast mining plants requires qualifications in the form of Professional preparation and work experience. The legislator decided that for some of these activities, the determination of professional preparation and work experience is within the competence of the employer, while for the remaining activities the qualification requirements are specified in the law. Also in the case of checking the possession of qualifications, the legislator divided the competences and indicated that for some activities the checking of the possession of quaIifications is performed by the director of the district mining Office, while for the remaining ones - by the employer. The lines of these divisions of competences do not coincide, which is the source of many misunderstandings in the process of entrusting acti- vities in the opencast mining plant operation. The article describes a detailed division of competences in the scope of determining the requirements for qualifications and checking possession of these qualifications - in the light of the provisions of the Act of June 9, 2011 - Geological and Mining Law. In the case of defining the requirements, the scope of the terms „professional preparation" and „professional experience" was discussed, while in relation to checking the possession of these reguirements - the tasks of the entities to which the verification was entrusted.
