TRESTNÝ ČIN NEOPRÁVNENÉHO USKUTOČŇOVANIA STAVBY A SPRÁVNE STAVEBNÉ DELIKTY

The article analyses the obligatory facts of the case of criminal offence of illegal construction development according to § 299a Act No. 300/2005 Criminal Code as amended by later regulations, compares this criminal offence and administrative delicts stated in § 105 and § 106 Act No. 50/1976 Coll. on Land-use Planning and Building Order (the Building Act) as amended by later regulations from the point of view of facts of the case, analyses the process of identification of this criminal offence by administrative body and also analyses the principle ne bis in idem in context of administrative construction delicts and this criminal offence. The article provides answers to questions of whether the provision of § 299a Act No. 300/2005 Criminal Code as amended by later regulations serves as effective prevention against unauthorised construction development or this provision is superfluous in the legal framework of the Slovak Republic. Answering on these questions creates a precondition for verification or falsification of the stated hypothesis.
