Statutory legal regulations providing Rules of Engagement (ROE) by Polish military units have been binding recently. They entered into force by the Statutory Law of November 26th, 2010 on the amendment of the Statutory Law on General Obligation to Defense of the Republic of Poland and of the Statutory Law on the Rules of the Use or Stay Military Forces of the Republic of Poland outside the Polish Borders. It is an important and necessary act filling the gap in the Polish legal system. A statutory description of principles, on which ROE have been created, gives a good basis for Polish soldiers to act during missions outside the Polish borders. It is a difficult subject matter, which demands reconciliation between the need of effectiveness of the Polish Military Forces in combat situations with the obligation of including international legal and constitutional standards of the protection of human rights. That the guiding idea of parliamentary works. In the situation of an armed conflict, those rights can be in some way limited, but by no means — derogated. Legislative works, which took place in the Polish Parliament over this Statutory Law, lead to reach an optimal result at that stage. It would be more appropriate to make this subject matter the following amendments, which the Senate of the Republic of Poland, among others, indicated.
