The issue of the law-making role of courts has been a subject of research interest for a very long time. The academic debate on the Court of Justice of the European Union and the so-called activism of this institution has also been going on in this context for several decades. The article starts with the assumption that even if attributing a legislative role to the Court is too far-reaching, its case law is at least pro-integrationist, that is its judgments are in fact very politically significant. The main purpose of the article is therefore to answer the question of what political consequences have resulted and continue to result from the case law of the Court. In other words, the purpose is to show the political influence of this institution on the integration process within the European Union. The second problem – the research question that will be attempted to be answered – is the problem of how such pro-integrationist activity of the Court can be explained. The article is prepared on the basis of the literature on the subject and the case law.
