Strony postępowania w sprawie o zatwierdzenie projektu budowlanego

The existing rule stipulates that parties to the administrative proceedings are determined on the basis of a general regulation contained in the Article 28 of the Code of Administrative Proceedings. The legislator, however, introduced in the Article 28(2) of the Construction Law a special regulation which is the basis for determining a group of entities having an attribute of a party to the proceedings related to the construction permit. This study presents rules on determining a group of parties to the proceedings concerning the approval of the building design, considering both the legitimacy aspect of participation in the proceedings as well as the legal administrative capacity conditioning the participation in the said proceedings. Attention was also paid to the imperfections of the current normative solutions in this respect, postulating their change.
