Zażalenie na odmowę dokonania czynności notarialnej - zagadnienia węzłowe

The article aims to discuss the basic issues related to the functioning of judicial control of notarial ac-tivities. This is achieved by means of a special complaint, which is filed with the district court. The au-thor discusses the origins of the current regulation as well as its procedural consequences. Disputes were presented in relation to the complaint and it was decided that the notary is not a party to the court pro-ceedings. It was also assumed that when performing legal protection functions, a notary may be consi-dered the equivalent of a court of first instance.
