Bezpieczeństwo rodziny w świetle znowelizowanych przepisów prawa polskiego - teoria i rzeczywistość

Providing the need for security fundamentally affects the ability of the individual to pursue life prospects and thus the quality and standard of living for modern families. The scale and complexity domestic violence indicates that the fight against it requires a determined and multi-faceted activity by the public authorities. Assuming this, such a goal is served by the newly introduced amendment to the law on preventing domestic violence. The present amendment introduces a range of solutions relevant and useful, however, analysis of individual provisions of the amendment raises a doubt whether the Polish law in its current shape, actually protects the family or - paradoxically - is a source of threat to it. The new law on preventing violence in the family has blurred the traditional, culturally and historically conditioned concept of the family, altering its accepted definition. In the name of counteracting domestic violence, it protects many ways of common coexistence, including same-sex relationships, while undermining the bonds of kinship of the extended family. Domestic violence is a social reality that requires strong state intervention, but this condition should not be combated by means which can be the ground for the development of further types of pathology. An amendment to legal provisions, even if it contributes to the fight against domestic violence, may not recognize the family as a whole and will not offer protection to all aspects of family life. The legislative shortcoming in question, and the subsequent dangers caused by such regulation cannot be regarded as a factor to safeguard the well-being of the contemporary Polish family and thus improve the quality of life for its members.

Die Gewährleistung der Sicherheit betrifft die Fähigkeit eines Individuums, um die Perspektiven im Leben zu entwickeln und die Qualität des Lebens der modernen Familien zu verbessern. Das Ausmaß der Gewalt zeigt, dass der Kampf gegen sie eine starke und facettenreiche Tätigkeit der Behörden erfordert. Eine Änderung des Gesetzes über die Gawaltprävention soll in diese Richtung führen. Die aktuelle Änderung hat eine Reihe von wichtigen und nützlichen Lösungen, sondern die Analyse der spezifischen Bestimmungen der Novelle wirft Zweifel, ob das polnische Recht in seiner jetzigen Form tatsächlich die Familie schützt oder - paradoxerweise - ist eine Quelle der Gefahr für sie. Das neue Gesetz über die Gewaltprävention verwischt das traditionelle, kulturelle und historischbedingte Konzept der Familie. Im Namen der Bekämpfung häuslicher Gewalt präsentiert eine Reihe von Möglichkeiten der gemeinsamen Koexistenz, einschließlich gleichgeschlechtliche Beziehungen, und schwächt die Bande der Verwandtschaft in der Familie. Die häusliche Gewalt ist eine gesellschaftliche Realität, die eine starke staatliche Intervention erfordert. Sie soll aber nicht durch die Gesetze, die die Grundlagen für die Entwicklung neuer Arten der Pathologie sind, überwunden werden. Die Änderung des Gesetzes, auch wenn es um den Kampf gegen die häusliche Gewalt geht, kann die Familie als das Ganze nicht erkennen und keinen Schutz in allen Aspekten des Familienlebens bieten. Die Gesetzeslücken und das anschließende Risiko einer solchen Regelung kann nicht als ein Faktor für das Wohlbefinden der zeitgenössischen polnischen Familie angesehen werden.
