Notatka na temat Postanowienia Trybunału Konstytucyjnego z dnia 8 maja 2024 r., sygn. akt U 4/24

The memorandum deals with the issue of the legal effects of one of the provisional decisions of the Constitutional Tribunal. Such decisions provide for various types of prohibitions addressed to public authorities; the prohibitions are to be in force until the case is finally determined. The memorandum analyses the admissibility of issuing such decisions. The analysis leads to the conclusion that the practice of issuing such decisions is unlawful.
