Pełnienie funkcji przez wójta po upływie kadencji na którą został wybrany

W myśl art. 29 ustawy o samorządzie gminnym wójt pełni swoje obowiązki po upływie kadencji do czasu podjęcia obowiązków przez nowo wybranego wójta. Z założenia przepis ten ma gwarantować ciągłość władzy wykonawczej w gminie. Zadaniem jego jest stworzenie podstaw do krótkotrwałego przedłużenia sprawowania władzy przez wójta po upływie kadencji, na którą został wybrany. W niniejszym opracowaniu autorka podjęła się próby zbadania, czy rzeczywiście przepis ten spełnia swoją rolę. W tym celu dokonała szczegółowej analizy nie tylko samego art. 29 ust. 1 u.s.g., ale także innych przepisów pozostających z nim w związku. W efekcie tych badań dochodzi do wniosku, że regulacja ta może stanowić podstawę do sprawowania władzy dla dotychczasowego wójta przez dłuższy czas, a w skrajnych przypadkach nawet przez okres całej kolejnej kadencji, co jest już sprzeczne z celem, dla której została ona wprowadzona do ustawy.

In accordance with article 29 of the Act on local government, a borough leader performs their duties after the end of the term of office until a newly elected borough leader takes on their duties. As it is assumed, the regulation is to ensure the continuity of the executive in an administrative district. Its task is to provide the basis for a short-term extension of exercising power by a borough leader after the end of the term of office for which they were elected. In this study the author has made an attempt to check whether this regulation really performs its role. To do so, not only has she made a thorough analysis of article 29 of the u.s.g. Act 1 itself, but also other regulations related to it. The effect of the analysis is that the author has come to a conclusion that this regulation may form grounds for exercising power for the current borough leader for a longer period of time, and in extreme cases even for the time of the whole following term of office, which is contrary to the purpose for which it was introduced to the act.
