Ústavní demokracie potřebuje demokratický mýtus

This article presents a multidisciplinary study in the field of constitutional theory on the interconnectedness of national identity, shared myths and liberal constitutional democracy. We start from the political- philosophical perspective that democracy is inherently a form of government with self-destructive tendencies and that institutional safeguards alone are not sufficient to resist them. However, we believe that the democratic culture on which all democratic institutions and practices are ultimately built could be the answer here. We identify the form of national identity and national myths as a critical component of democratic culture, provided that they serve the image and practice of democracy. We link these conclusions to the societal role that the constitution and its actors play, especially the role of the president of the republic. We use the example of TGM to show what a practice of cultivating democratic myths may look like. Our core argument is that without a democratic national identity, which is directly derived from shared democratic myths, democracy cannot function in the long run.

Tento článek představuje multidisciplinární studii v oboru ústavní teorie o provázanosti národní identity, sdílených mýtů a liberální ústavní demokracie. Vycházíme zde z politicko-filozofického pohledu, že demokracie je inherentně forma vlády se sebedestruktivními tendencemi a že pro institucionální pojistky samotné je velmi těžké se těmto tendencím bránit. Předkládáme ovšem, že tuto roli by mohla sehrát často opomíjená demokratická kultura, na které jsou nakonec všechny demokratické instituce a praxe postaveny. Jako klíčovou součást demokratické kultury identifikujeme podobu národní identity a národních mýtů, a to za předpokladu, že slouží obrazu a praxi demokracie. Tyto závěry posléze propojujeme s úlohou ústavy ve společnosti a s jejími aktéry, především s rolí prezidenta republiky. Na příkladu Tomáše Garrigua Masaryka ukazujeme, jak by praxe kultivace demokratických mýtů mohla vypadat. Naším základním argumentem je, že bez demokratické národní identity, která přímo vyplývá ze sdílených demokratických mýtů, nemůže demokracie dlouhodobě fungovat.
